I wonder if anyone would be able to provide any advice regarding a reference problem that I am having. On 29th October 2009 I was made redundant from a London Council after 10 years- the 29th being my last day of service. On 3rd November 2009 I received a letter (which I signed for) at my home address dated 28th October 2009 saying that the council were carrying out an informal investigation into anonymous emails which criticised senior managers.

There were around 15 individuals who were made redundant at the same time. The letter said that I had been invited to an informal meeting on 29th October 2009 to discuss the matter although I only received the letter on the 3rd November 2009!. I emailed the person who wrote the letter to say that I had only received the invitation on the 3rd November 2009. I went on to say that as I was no longer an employee of the council, I could not see the point in helping them with their enquiries and that under the circumstances (making me redundant) I didn't feel the need to assist them.

Then on 15th January 2010 I received a letter dated 13th January 2010 from my old employer saying that they had finished their enquires and that had I still been employed by them they would have proceeded to hold a formal disciplinary investigation against me based on 1 persons testimony. I emailed back saying that this was crazy and that I had no interest in this rubbish.

Since then I have seen a copy of a reference that they have supplied and amongst other things it says and I quote "At the time of his redundancy he had a pending investigation under the councils disciplinary procedure". Clearly if this is what is being said on my reference that would explain why I have found it difficult to get a job despite applying for over 80 since I was made redundant. I don't believe that I was being formally investigated at that time and they may have not followed ACAS guidelines because to me informal and formal have 2 different meanings so in essence "at the time of my redundancy" I was not subject to a pending investigation. ( I think)

Any advice on what I can do to rectify this or am I stuck with it. I am taking them to an employment tribunal in Oct should I raise this then?
