My step daughter works as a Vet Nurse at an hourly rate plus a premium overtime rate. This week she had a car crash which meant that she was not able to go to work. Upto that point she had carried out overtime hours. The firm are not paying her for the sick days but they are also saying that they are not going to pay the overtime premium. Is this legal. Example of what happened
Day 1 normal hours plus overtime at premium rate
Day 2 normal hours plus overtime premium rate
Day 3 sick no pay
Day 4 Sick no pay
Day 5 Sick no pay
so on the two days she had worked she had done about 4 hours in total attracting the premium rate, also can they refuse to pay her at all for the extra hours carried out.

It really depends what her contract says about the overtime payments.
What does it say about when the premium rate applies?
If it's for any hours worked over and above x number of hours in a day, or for any hours worked outside normal 'office' hours, then she should be paid it.
If it says the premium rate applies for hours worked over and above x number of hours worked in a week, then they can probably withhold payment legally.
Can you quote her contract on here with regard to overtime?

Forgot to add, they can't refuse to pay her at all for hours she has worked, the only question is whether the premium rate applies.
