9 days short of 2 years...

    Default 9 days short of 2 years...

    hi

    i`m being made redundant from the end of june this year. unfortunately for me i started working at this company on the 9th of july 2007 which means that i`m treated as `less than 2 year` employee. that is only one week notice and no redundancy packet. i already been told that we are going to get paid that notice in leu.

    i`ve rang the acas help line and been told that `if my notice worked or payed takes me over the date of the 9th of july i should be treated as employee with over 2 years of service`. with my branch being closed at the last day of june and one week notice that would take me to the 7th of july - still 2 days short.

    my question is: i still got my 2 days of holidays to use till the end of june. i know i can leave them and get paid instead. if i get paid for those 2 days will it count as extra 2 days of my employment with that company? i`m sure you already know where i`m going with that

    Hi

    I am sorry to hear that you will only be 2 days short of the 2 year qualifying period for redundancy pay. You must have at least two years of continuous service with an employer before you are entitled to a redundancy payment.

    With the law as it stands at present outstanding holiday entitlement wouldn't count towards your notice period I'm afraid.
