sickness and redundancy I have been off work sick for nearly 2 years now, I have serious depression and am seeing the phsychiatrist at the hospital. He has put me on lithium tablets but these do not seem to be working. I work part time, 16 hours a week, and now work are talking about dismissing me. I have applied for and got Dissability Living Allowance, care and mobility. I love my job and would very much love to return to it one day but I understand the concerns of my employer. I have been working for them for 9 years now. I would like to know what my position is regarding redundancy. Would I be entitled to receive redundancy or can my employer dismiss me without any payment.

Ultimately an employer can dismiss fairly on the grounds of ill health however this is not a redundancy situation and is a complex process and they should firstly consider what reasonable adjustments might help them you to remain in work.
Your employer can only terminate a contract of employment on the grounds of redundancy if there is a genuine redundancy situation e.g your position is no longer required.
Without the full facts of your situation, I am unable to comment too much but you may be eligible for a final payment if you are dismissed on grounds of ill health. Details of this should be in your contract of employment of employee handbook. Early retirement may be another option if you are over 50.
