The company I worked for went into administration and was bought within two days.
After going through a consultancy period of 30 days, on April the 14th I was made redundant after serving 12 nearly 13 years with the company.
I was sent a letter confirming this which arrived on the 20th of April. In the letter it stated that if I wished to appeal I would need to do so in 7 days from the 14th. Obviously this would not give me enough time. After thinking about what to do I decided not to appeal.
During the consultation period I put forward many questions regarding redundancy pay. I was informed that this would be at the statutory amount of £350 per week. Also I questioned if I would get 13 weeks as I had worked 12 years and 10 months. I was told on more than one occasion that only complete years would be paid.
Over the last year and a half I had to deal with making others redundant myself. at this time they were all paid a normal weeks wage for redundancy. Also anyone who worked over 9 months of a year was given a weeks pay.
Since then I have been informed by my colleagues who were also made redundant that an employee who had worked for the company for only 8 months had been paid her 3 month notice period plus one weeks redundancy pay at an amount of £500!!! At no time during the consultancy period was any discretionary payment discussed. We were always told it was capped. Also by paying them one weeks this goes against what they had advised me.
My colleagues are appealing this. What should and can I do??? Do I stand a chance of getting anywhere with this?
