Hi
I was wondering if anyone could help me with some questions regarding redundancy, please.
I was informed by letter on the 07/04/09 that I had been shortlisted for redundancy and I am not sure about what is going to happen and whether I will get a package. I have been told there will be 3 meetings and they are looking to get the whole process wrapped up asap, (within about 2 wks).
The company I work for are a large international IT consultancy firm but the UK branch which I work for are a small/medium sized company.
Some background info on me:
I started with the company on 10/02/2006 and my role is IT consultant. I have worked for them for just over 3 years. I do not know how much my weekly salary is, but my annual salary is £42436, (I also get a car allowance and a flexible benefits pay but not sure whether or not that info. is required).
I am 32, (turn 33 at the end of May) and I am a full time, permanent member of staff, (not a contractor or temp.).
I suspect they have been wanting to get rid of me for a while, as I was on long term off sick from End of Aug last year - Dec last year, (the duration was mainly due to HR manager being off sick as well and they wanted me to see an occupational therapist which they were to organise and as the HR manager was off sick, it dragged on and could not be sorted out until her return, thus I had to keep extending my sick off as well as use up all my annual leave entitlement in between). I did mention at the time that I felt it smacked of constructive dismissal but was told it wasn't and now feel the redundancy is being used as a disguise.
The company are not going bust, they are simply downsizing due to them not making profits and not getting any new contracts.
My questions are:
1, Given my service and age how much am I entitled to roughly?
2, How much notice does my firm have to give me once they have announced I will be made redundant? I have been told there will be 3 meetings and they are looking to get the whole process wrapped up asap, (within about 2 wks). I had the first meeting yesterday, I was informed the next meeting will be next Tuesday the 05/05/09.
3, During my notice period do they have to pay me my wages in full up until my last day?
I really appreciate any help you can give me.
Thanks v much in advance.

Hi Cindyboo
Statutory Redundancy Pay is what your employer has to give you by law if you are made redundant. The amount of pay you receive is calculated using your age and length of service). You can calculate the SRP by using the redundancy reckoner calculator
In the first instance, you should check your contract of employment or employee handbook which should contain information about your redundancy entitlement You may have a contractual agreement where your employer has agreed to pay you above and beyond the statutory minimum.
As well as a redundancy payment, your employer should pay you through your notice period, or payment in lieu of notice to your last day. Pay in lieu of notice is money paid to you by your employer as an alternative to being given your full notice. Details of the notice period will also be in your contract. As a minimum, the notice period would be 3 weeks.
There is no time limit to how long a consultation period may last but there is a minimum period between the start of the consultation and actual dismissals if your employer is proposing to make 20 or more redundancies. I am unsure how many redundancies your employer is proposing to make so i can't comment fully on this.
If there is less than 20 proposed redundancies, a two week consultation period is reasonable providing your employer carries out a full consultation with you looking at alternative employment and ways of avoiding the redundancy.Clara Buckingham
