I'm a pilot flying a private Exec Jet. I was employed over 2 years back by a management company to specifically fly an aircraft for a private owner. That aircraft contract went to tender and a new management company won. I had to take the initiative with the new management company before they acknowledged that my employment should continue under TUPE.
I have just met my new employer on day one of the transfer to be immediately informed that he has to make a pilot redundant i.e probably me.
Compared to one of the other in-house pilots I am more experienced, better qualified and cheaper - my salary package is about £20K less. Last in first out would count against me as would location from the base airports - about 80 miles.
I believe the TUPE process was incorrect as there was no consultation.
I also believe the redundancy procedure to be flawed.
What can I do to defend my position and if it does end up at an employment tribunal what kind of award might I expect? I earn £80K and the job market is dire.
