I will try and keep this brief. My company is re-structuring. There are 3 levels within the job i do; junior middle and senior. We are kind of team leader / account managers. The middle level is being taken out. This affects me and 2 others who are maternity leave.
The difference between a junior and my middle position is that junior is allowed guidance but has the same job description. The juniors and seniors were not looked at.
There is a junior position in the new structure in place of mine. I haven't been offered this role, it is being given to someone moving from another team. This person is less experienced and was only with the company 6 weeks when i got my 'at risk' letter. Since the letter they have taken on a senior, and another junior and also a head of department which is senior management.
The reason for the restructure is to save money because of the down turn. The company has increased it's business but says the bottom line profit is lower. They wont provide the figures or even % comparisons.
How can they say that they are tying to save money when they have taken on more staff and given my job to someone else?
The only other roles offered were really unsuitable one i needed 4 years training and the rest were less than half my salary!
I have been with the company 11 months so when they give me my 4 weeks notice it will take me over the year needed for unfair dismissal. Do I have a case?
Any advice would help, i'm going round in circles trying to research as the laws seem complicated.
