Default 2 yrs service period kicks in during notice period

    Hi all,

My company announced nearly 2 weeks ago they were shutting our office down and laying off all 22 of us...

We are currently in the consultancy process but there is no doubt we will be served our months notice on 14th May.

My 2 years of service will kick in on 4th June - during the notice period. I have been told that I do not qualilfy for Statutory Redundancy as I must have served 2 years notice before the notice is issued.

Can anyone confirm this for me please?

Many thanks and good luck everyone! It's my first time being made redundant and it's horrible

Default 2 yrs service period kicks in during notice period

    Hi there,

My notice period takes me over 1 year and I want to take my employer to a tribunal. I have sought legal advice and been informed that notice period does count. I'm not sure if it's the same for redundancy money.....

    Hope that helps

Hi I'm in the exact same situation and I'm going to the citizens advice bureau tomorrow. I'll post my findings on here tomorrow afternoon.

My situation is slightly different in that I have a letter that states I AM eligible for the payout. However if I haven't worked 2 years between whichever 2 points it is I imagine that counts for nothing anyway!

    Hey,

    Also check this out...

Assuming that is true and still applies then I'd say in our situation we are pretty safely covered to get our payouts. Your period of service is calculated from your start date up until the END of your notice period.

    woop woop!

    What a releif...

Hey, thanks for getting back to me! Much appreciated...

However, I actually got an email from our head of HR a couple of weeks ago saying that as I am so close to the 2 year mark, I will qualify for the statutory redundancy payments. I don't know if this is 'official' or a decision taken by the company but I was pleased to hear it.

    Good luck with it all....
