I am currently employed by a major multi-national company with a presence in the UK. There has been continual restructuring for several years, and a succession of senior management personnel.
I was given 'at risk' notice recently and am now in a month consultation period. The cause is a budget cut for a particular type of project activity. The budget cut is equal to a number of people, but I am the only one put at risk as my project is ending, whereas some funding has been scraped together for other staff to finish partly completed projects. All affected staff have different job titles (Which tend to refer to the type of project they are working on rather than role description).
THe company has a number of new jobs available and these are advertised both internally and externally. The HR department does not seem to have the ability to check if my role is similar to any of these jobs, and has left me to apply with everyone else.
It seems that the company is behaving unfairly on several grounds:
1) Selecting on job title and project responsibility
2) Not searching properly for alternative employment
3) Not ring fencing potential jobs - and even recruiting externally
Various explanations have been given:
1) Job is a distinct role and other people have managed to secure funding
2) The company and the roles are too complex to allow searching for alternative employment
3) They are not required to ring fence jobs

This leads me to several questions:
Should I take legal advice on this?
Should I take advice now or wait until a dismissal notice is issued
