    Default Compromise / maternity pay

    Hi There, I am hoping you can help me.
    I have a compromise agreement in my possession; it details my terms for leaving at the end of September. The project I am working on has been extended and I have been told verbally that I will be re-issued with another compromise agreement that extends me until the end of December. I will have the option to refuse or accept this new compromise agreement.

    However... I have just discovered I am pregnant and my due date is 6 Nov. I have a couple of questions:

    For Health and Safety reasons I have had to tell my boss that I am pregnant, but that the information should be kept confidential until I am 12 weeks PG. On the grounds I have been told verbally I will be issued with a new agreement, should I still expect it to be given to me? (The new agreement would take me to another year's service and thus a better payment.)

    Can I expect the company to pay me Maternity Pay prior to my leaving? And is this dependent on whether I am scheduled to leave in Sep or Dec? I would be contractually entitled to enhanced terms - should I expect these?

    And finally, I am on a retention bonus to stay till the end of my employment. At the moment the end date of the letter is 30 Sept - again can you advise me on whether the company have any grounds to recind this offer??

    Dear Websie

    I am perplexed as to why you've been given compromise agreements and then staying on for 9 months, this is highly unusual.

    Anyway, why dont you wait until the new compromise agreement is used and as you have to seek legal advice on this, paid for by the company, you could ask their advice on your maternity leave and pay.

    However, I would inform you that if you are being made redundant then the COmpany is obliged to continue to pay you your maternity pay even though you would have left, if of course you are on maternity leave at the time of the redundancy.
