    Default Redeployment and Trial Period

    Hi

    My role was put at risk in December. I accepted an offer of redeployment for an 'alternative role ' on 9 February, and signed a new contract with a higher salary and longer notice period (12 weeks instead of my original 8).

    I have now decided the alternative role is not suitable for me. My company first offered me a PILON of 12 weeks at the higher salary, however a day later they said there was a mistake and offered only 8 weeks at my original lower salary.

    I am confused, should they not pay the 12 weeks?? is the new contract void?

    Dear Ingrid

    If the job was offered on a 4 week trial then that was up on 8 March. You should not have signed any new contract until the end of the trial period. Therefore, your original contract of employment still stands and if that contract allowed for 12 weeks notice then that is applicable.

    I am sorry this might not be helpful, but your situation is not clear and I dont know why you signed a new contract until the trial period had finished.

    You will have to challenge your company on why they even issued a new contract to you and also why the notice period changed. If you have done 12 years service you would be entitled to 12 weeks. You will need to review your current (but old) contract as to your contractual notice period though.

    Hope this helps but challenge now as the trial period has effectively ended and you might not have the option of redundancy.

    My situation is similar to Ingrid.
    I have been offered an alternative role on a trail period of 3 months (I have not agreed to 3 months yet and have said that I will think about it), with same renumeration packabe as the current role. But if I were to take the alternative role, I will be given a new Contract of Employment with new notice period.

    Although the the redundancy calculation given to me is based on length of service and includes value for the notice period based on length of service, If I take the trial period for alternative role, do I lose the current notice period payment (this is substantial)?
