I have been through redundancy consultation twice in the last five years with my current employer. Both times I was offered enhanced payments (2.5x that of the statutory equivalent plus paid notice period) or the option of alterative roles.
I chose alternative roles.
My current role is now to go but the company is offering only statutory entitlement despite still making large profits.
My contract makes no mention of reduncy terms but I have written proof of previous potential payments.
Legally can I insist on an equivalent enhanced payment?

Contractual Enhanced Payments

Hi welcome to the forum.
A contract of employment the contract may be written or verbal or a combination. Some terms and conditions may become part of the contract through established custom and practice.
If your employer regularly makes the same enhanced payments, they can become an implied contractual entitlement on the basis that they have been custom and practice.
You could dispute the statutory redundancy payment offered by your employer on this basis.
I hope this helps.Clara Buckingham
