    Default Redundancy with work ongoing

    Hi, I was made redundant about a month ago, while in the middle of doing an important project for my company.

    I was put into a pool with several other people with the same "job code" as me, but in reality I had completely different skills to the others in the group. I was viewed as having "non-core" skills, and therefore selected for redundancy.

    However, the work I was doing is ongoing (well, actually postponed now), and as no one else has been identified to continue doing this work throughout the old company, there are moves being made to employ a contractor to continue doing this work.

    My question, therefore, is pretty simple really: how can they employ a contractor to continue doing this work when the job has been made redundant, and do you think I should bother pressing for unfair dismissal? They have even informed me via email that I am free to apply for the job myself, if their rules allow!

    If you find it a little odd as to why an employer would actually shoot themselves in the foot like this, you're not alone!

    Hi

    Assuming you had at least one year's service when dismissed, I think you probably have grounds for an unfair dismissal claim.

    If the job is still there and they are advertising to replace you, it should be fairly easy to show that the reason for your dismissal was not actually redundancy and, therefore, it will be unlikely to be found fair.
