    Default Can You Make Yourself Redundant. I'm a director

    Hi There,

    I am a Director of my limited company, I basically contract out to engineering companies, however work is about to dry up and I will be with no income coming into the company.

    Can the company make me redundant? Is it legal to do so, any pit falls, Any advice will be appreciated.

    Dear Mark

    I am a bit confused about your Directorship in the Company. Are you listed at Companies House and have shares? Or are you a Director by title only?

    I dont understand why you are contracted out to companies, are you a one man limited company?

    Anyone can be made redundant provided the selection of that position is fair. You mention that the work that you do is diminishing and therefore the risk is there.

    However, before you are made redundant there is a process to be followed and you have the right to consultation where you can discuss ways to avoid the redundancy, ie another position, salary reduction, etc. etc.

    However, this is all depends on the contract of employment you have and if its your own limited company and only you and there is no work then the company is insolvent and you are out of work.

    Without the full facts it is hard to actually advise.

    yes i have never been out of work before but times are changing and the is a real possibility i will not be able to get work soon.

    with no work coming in, does this make the company insolvent?
