    Question Redundancy pay - Enhancement to Statutory

    Hello

    A bit of background: Last year everyone in the company was put at risk of redundancies and a vacancy list was provided, with my job being on it. We were told that we could apply for voluntary redundancy or apply for our own jobs. If VR was accepted we would get statutory redundancy plus 1 month's pay tax free plus 1 additional statutory week's pay, along with notice and holidays. At the time I knew that I wouldn't be made redundant because they needed me in that position but i knew it wouldn't be for long.

    So I asked the question, what would happen if my job was made redundant further down the line - would I get the same enhanced redundancy package like everyone else? I was told verbally by the gentleman who was in charge of dealing with all the redundancies that Yes I would get the same. This was only verbal.

    Now I was told on Friday that my position is to be made redundant and i'm currently in the 7 day consultation period. I'm worried that despite several people receiving the enhanced package since the bulk of the redundancies, that they might just give me statutory.

    Is there anything I can do to ensure I get the same as everyone else?

    Hi. Welcome to the Redundancy Forum. I am sorry to hear that you may be made redundant and I hope I can help you.

    Firstly, you should check whether you have a contractual right to receive redundancy pay at a higher rate than statutory redundancy pay. You will find this information in your contract of employment.

    Your employer should issue you with a statement of your redundancy payment you will receive. If you have an expectation to receive an enhanced redundancy package arising from what you have previously have been told, I would advise that you confirm this during your consultation period.

    If your employer refuses to pay an enhanced package and you think this in unfair, you should either appeal or raise a grievance.

    Hi there

    Many thanks for your reply. I'm sure i'm not contractually entitled to receive an enhancement. When you say "appeal or raise a grievance", how would i go about doing this? would it mean going to a tribunal/seeing a solicitor?
