    Default trial period and pay in leui

    I have recently been made redundant and was offered 6 weeks notice pay and statutary redudancy pay.

    my employer has offered me an alternative position in the company of which i will take a 4 week trial, the alternative position has less status and less pay then my current redudant position, but i like the compnay so am willing to try the alternative

    my question is- if i decide after the 4 week trial that this is not a suitable position i know i am entilted to the Stat redundancy pay but will i still get the 6 weeks notice pay also? and would this be at my current pay or the new pay?

    Hmmmm. That isn't an easy one to answer. The fact that it is pay in lieu of notice definitely complicates things. That isn't at all normal and the law isn't clear cut because of that. My opinion is that you should still get your notice at full pay - but that may include the work trial. Your employer may have their own thoughts on this - to be honest, it would be best if you ask them the question and see what they say. If the answer is ok by you, fine; if it isn't come back with what they have said and we'll take it from there.

    Thank you for your reply, i will ask them.

    If the 4 week trial could be considered as part of my 6 week notice, should the 4 weeks be paid at my old rate of pay then?
