    Default Director sent redundancy letter that never arrived

    Hi,
    my husband went to work today where he is a Director and responsible for bringing in new business (which he does consitantly) and was informed by his business partner that he was now redundant as they could not find work for him full-time anymore, and that a letter had been sent out 4 months ago to tell him. We never received a letter, and asked to see it. We were given a copy of it dated 30th September that had been sent to our old address (we moved 2 years ago!), and it had not been sent registered, cc'd electronically or on paper to my husband. So until today we had no idea it even existed.

    Letter also said that no redundancy pay had been decided yet, just 1 months salary. The company has existed for 5 years approx.

    Husband had no idea that any of this was in the ether, for the last 4 months his partner has refused any meetings with him (today he said it was as the employment lawyer recommended this course of action), and there was no notification formally of any consultation that we can find. There was a casual conversation in early September when my husband and his partner discussed my husband dropping his days at work down (my husbands move as he felt he could still bring in work for the company and also do other ventures on other days), and the partner said he would discuss it again. Then 4 months of silence and now this.
    If the letter was never seen until now, and my husband has been unaware of this action, how does it stand legally? I thought that you could only remove/sack a director if they were incompetent and they were the hardest people to remove from a company. Husband and partner own 35% shares each.

    Sorry -it appears he isn't an employee. This is a company matter and my knowledge of company law is limited. He needs to see a lawyer.

    Thanks, but I would still like to know in normal circumstances what is the procedure for redundancy? i.e. letters/meetings/consultation processes. As an employee of the company that must still be relevant, and the Company law regarding getting rid of directors mentions usual process being adhere to...

    Sorry - but you can easily google normal process. But this isnt normal if he isn't an employee. I assume, but I am guessing based on very old lectures over30 years ago that there has to be some kind of shareholders meeting to determine this sort of termination.
