    Default at risk of being made redundant and feel i am being forced to re-apply???

    Hi All,

    I am at risk of redundancy, we have been told that out of 55 people being made redundant that 28 new jobs will arise from this.

    I have been told by my company that if i do not re-apply then i must given written justification of why and that if this is not agreed then i am at risk of not being paid redundancy pay.

    from all the websites i can find it says "If your employer intends to make you redundant, they must consider whether there are other jobs available which you would be capable of doing.

    If a suitable job is available, your employer should offer it to you instead of making you redundant.
    "


    In the case here we are not being offered the positions, we are being told we must apply for any of the new jobs, these are not released to use until we recieve the letter confirming we have been made redundant.

    To me this is not the same as being offered the job as i must apply and go through competetive interviews after i have recieved the letter of redundancy.

    can anyone confirm if i am understanding this correctly as this would be deemed as unfair dismissal??

    No you are not understanding this correctly. The employers interpretation is correct. If you fail to apply them you are refusing a potential job and redundancy can be withheld
