    Default Effect on redundancy pay if I leave before end of the notice period

    Hi

    I'm about to be made redundant with 7 weeks notice. I'm entitled to 10 weeks redundancy pay. I've read that if by mutual consent I can leave earlier than the 7 weeks, I need to follow the correct procedure or I may lose some or all of my redundancy. What is the correct procedure please?

    Also, if the end of the notice period takes me into my 8th full year of employment does that count or is it only the full years up until the date redundancy notice is given?

    It is the end date.

    If you are in your statutory notice period AND have another job to go to that wants you to start earlier, you may serve counternotice and ask to leave earlier - the employer doesn't have to agree but should not unreasonably refuse. But you won't get the full notice pay. -only the period you work.

    Thanks. I accept I wouldn't get full notice pay if I left before the end of the notice period but would it affect the amount of redundancy pay.

    Not if the employer agrees. You cannot leave without their agreement or you get nothing at all.
