Contract & notice period advice

    Default Contract & notice period advice

    Hi There,
    I have just been made redundant, (jan'11) was working for a really small firm,
    just need to clarify a couple of points.
    I had started in Dec '09, only on a 4 day per week basis, to start with but changed to full time in June'10,
    I think I am due redundancy of 3 weeks as I am over 41, am I correct?
    Also my contract which is dated June'10 states 4 weeks notice or 1 week per completed year, whichever is greater, my termination letter states only 1 week notice, they justified this to me saying as i am paid weekly this is correct and they stated that i have only completed 1 years service!
    Please can you advise me and if I am correct and what course of action should I take?

    Unless there was break in continuous service that you have not mentioned then you are correct.

    Your first action should be to write to the employer giving them a chance to pay what is owed to you, whiilst preparing an ET1 (tribunal claim form) for just in case they don't pay). Alternatively you could ask for ACAS pre-claim mediation instead of writing the letter - but still do the claim form in case they don't pay up. you only have three months less a day to make the claim, from your late day of work.
