    Angry Made redundant - am I being paid off?

    I was made redundant last week. At my appeal the decision to dismiss was upheld. The reason for my redundancy was a follows

    The company making 84 redundancies
    Consultation with unions commenced and discussions centred around selecting people from a pool based on agreed selection criteria.
    There was mention (in a 10 second conversation) that there would be some 'job specific' job losses.
    At my dismissal I was told that my manager was instructed to lose one of his 3 administrators - choice was myself (HR Officer), the payroll officer or the H&S officer. He decided that it would be me because my role could be shared out the easiest. That was the only justification I got. To add insult to injury I work part time and am the only one out of 500 staff!!

    At my appeal, a compromise agreement was discussed. The company came back and said they would offer £3000 on top of redundancy if I accepted. I said I wanted £6000. They came back and said £4000 final offer. I said I would think about it and left the premises. I hadnt even left site when they called me back and said they would increase it to £5000 and that it was a generous offer.

    Any advise please regarding whether I have claim for unfair dismissal or whether I should take the money and run.

    The decision is yours. The payments in a compromise agreement are free from deductions, so £5000 is a good sum.

    However, if you believe that your selection and dismissal is unfair then you could not take the compromise agreement and make a claim via an Employment Tribunal. However, there is no guarantee that you would win.

    My advice would be to ask them to give you a compromise agreement that you can take to a solicitor for advice (the company paying the solicitorrs bill is part of the agreement) and see what they believe your best options are based on all the documentation you can take them. However, state that the compromise agreement is issued on the understanding that it is not accepted at this point until you have taken legal advice.
