    Default Redundancy during secondment

    Recently my host position has been identified as at risk of redundancy during group consultation.
    I'm currently on secondment in a different department of the same company. Secondement was for a fixed time until the end of Feb and included some additional incentives like acting up allowance and completion bonus.

    Date stated for when I'll become redundant is end of December. This of course mean that my secondment will also be shortened by two months.

    Employer prepared redundancy package which is based on my host position (i.e. lower salary). What does bother me is that my secondment has been shortened and will not run as my additional agreement with the secondary departments states.

    Do you think I'm entitled to compensation for any loss of earning (acting up allowance) as result of this or alternatively should my base salary for the reminder of the secondment term include the acting up allowance?

    I would like to consult with legal adviser but I first want to test my position.

    D'ya know what? This one has me stumped! Because I genuinely don't know the answer. Although I know redundancy law, I generally deal with the complex case law of it, and this one - well, it's kind of odd! I can think of several answers which you would like - and several you wouldn't! Which tells me that the answer lies in the conditions of the secondment, which are not regulated by law. You certainly aren't entitled to "compensation" - but whether you may be entitled to redundancy payments at the higher level of pay....? Generally allownaces etc are not part of basic pay and can't be included, but there are exceptions and without all the exact details and paperwork, I really can't say. Maybe Jarndyce may have some ideas, but I think you may need to consult a solicitor to get a straight (ish) answer. Sorry!
