    Question Garden leave

    Hi
    Advice on garden leave

    I have recently been selected for redundancy and my employers have said they want me to work my 3 month notice period.
    During a recent consultation meeting they advised me that I would be on garden leave on the days they have no work or projects for me to complete - but that they want to know my movements during the day?
    Can they do this?
    I have had no contact with them since my meeting a week ago, they have confirmed my notice of redundancy in writing, but have not responded to my email requesting clarification on the expectations of me during my notice period - I take that I am on garden leave ???- but they did not confirm this in writing it was only verbally discussed at my consulation meeting.
    If they want to know my movements I would have expected some infromation from them or for them to contact me on a daily basis to see what I am up too!!

    Dear Rose 77

    Garden Leave has to be a contractual entitlement or a mutal agreement, did you agree to this? Is it in your contract?

    Also, I am not sure if you have had the full consultation and been informed that you are redundant.

    When was your final consultation meeting when they confirmed this to you verbally?

    I would go into work and sort this out if I were you.

    However, if you are on garden leave the terms of this will be in your contract, if not then yes they can ask you to be available for work as requested.

    Therefore, go into work and sort if out and then come back to us for further advice.

    Also, check out the BERR website to see if they followed the statutory redundancy process.
