Hi,

First post - I wonder if anyone can help out?

My employer went into administration recently - pre-pack administration, with the new company taking over the assets and most of the employees including myself.

The company claims that the takeover is not under TUPE regulations - and as such has sent out contracts at a 10% pay cut and with different terms etc.

This being the case, I would have thought, with over 2 years service, I could then claim for redundancy and loss of notice from the administrator - however the company are saying that this is not the case, and that the new job offer rules out redundancy claims despite not being TUPE compliant.

Can anyone advise? I thought it is either TUPE or it isn't - is there such a thing as partial TUPE?

Thanks in advance
