Consultation Process - Final redundancy package I was informed on Monday that I am to be made redundant, but that we are now in a 30 day consultation period and that notice will be served on 2 March. I asked what the implications were financially. Would I receive statutory redundancy together with my final months salary then or would notice then be served, as I was led to believe that notice would be served once the consultation process finished. No-one was able to answer my question. Could someone let me know, as I don't think the company know what they are doing.

Thank you for your question.
Consultation should cover ways of avoiding the redundancy or mitigating the effects. Redundancy notices can be issued only when the consultation has been completed. . If consultation has been completed within the 30 day period, the employer may issue notices at that point.
Redundancy notices takes effect at the end of the your contractual or statutory notice period (whichever is the greater). The period for the redundancy to take effect varies according to your notice period. Can you tell me how long you have worked for your employer or how long your contractual notice period is? Details of the notice period will be in your contract.
If your employer is paying the redundancy pay, it should be paid on the last day that you work or as soon as is possible after.

Redundancy Consultation Hi
Many thanks for your advice.
The situation is as follows:-
Advised on the 2 February that my position was under threat of redundancy and that consultation would now take place, i.e. 30 days. However, the company were vague on when I would be served notice and that my position of employment would cease in 30 days.
I thought the notice would be served after consultation? I have worked for the company since July 2005, I have to give a months notice, but I believe I will only be entitled to 3 weeks statutory redundancy.

Are there more then 20 redundancies to be made at your organisation? I'm not sure from your posts whether this is a collective redundancy situation.
The consultation period is 30 days although it is not necessary that consultation should last for all of that time. It is necessary however for the parties to have reached agreement for the consultation to be complete.
Notice can only be served upon completion of the consultation period.
You employer should disclose how redundancy payments, other than the legal minimum, will be calculated. This information should also be in your contract of employment. If you are only entitled to the statutory minimum, you will be entitled to notice pay of one week for each complete year (up to a maximum of 12). Your redundancy pay is based on years service and your age.
