On Thursday 15th January I went into work as normal, my director walked in (an unusual occurrance, so I looked shocked), she said I take it you have not had your letter yet? I said no, she showed me a copy of the letter which said that I was at risk of redundancy. She said you should go home now and look for another job and sort out nursery, I will need you to come back next Thursday for a meeting, when I asked what for she said oh just something we have to do by law.
I took legal advice and was told that the procedure that they had taken was incorrect, as there were no warnings given and the letter should not have been sent out before I was consulted. I had not had notice of redundancy in writing either.
During the time I was off work, a colleague informed me that people were told I was redundant and that they had arranged cover for my job, 3 days a week to be covered by a manager and 2 days by another collegue. Employees had been told that it was because I was the only part-time worker.
I attended the meeting, the director said that this was my time to offer up any options. I asked some questions, I asked what the selection criteria was, they looked blank and said well nobody else was considered, your position is part-time (30 hours a week) and so it is easier to absorb the hours. They confirmed this twice in the meeting. I told them that I had taken legal advice and that their procedure was incorrect. I told them that I would have considered taking a full-time position instead. I gave them some suggestions, e.g. make somebody else redundant and put me in their position. They said that they would discuss this and would like to speak to me again on Monday 26th January. At this point the director asked me what I planned to do with the advice I was given, I said it really depends on what happens on Monday. Still no notice of redundancy. I asked for a copy of the selection criteria and point scoring system and was told that there wasn't one.
On Friday evening I received a telephone call from the director telling me that they would like me to go back to work as normal on Monday 26th January, whilst they consider their options. I am now obviously confused. I know that they have taken legal advice as I have been informed by a colleague.
Has their legal advice been to take me back on and follow the correct procedure to get rid of me?
Have they discriminated?
If they offer me another postion, what are my rights?
Can they make me redundant now and give me another reason?
Any advice would be gratefully received.
