On maternity leave, received p45 in post!

    Default On maternity leave, received p45 in post!

    HI

    I'm on maternity leave at (10 months) now, due to go back in feb. This week i got a payslip with a p45 in the post with no explaination. I contacted the director and he said it was a mistake that the payroll company shouldn't have sent this to me but i called them and they said to me they had a note from him to say i'd left the comapny! He's asked me to go in for a meeting next week, I believe this meeting will be a 'consutation' where he will tell me I'm made redudant but the decision has already been made. I believe the mistake is I shouldn't have found out that the decision had already been made.

    What should I do, should I just go what sort of compensation could i get or is it a lot of stress for not much gain?

    So stressed about this - please help.

    I am sorry that you seem to have been treated incorrectly. From what you say it seems an error has been made and they are trying to rectify it, although as you say it seems the decision has been made.

    However, if you are being called to a meeting next week to discuss the fact that you are at risk of redundancy they should have put this all in writing to you in line with the statutory redundancy process.

    However, if you have agreed to go the meeting they cannot tell you that you are redundant at the meeting but that either you or your position has been identified as at risk of redundancy.

    My suggestion as I said is to go the meeting see how they manage the situation and read up on what they should be doing by following the statutory redundancy process that outlines the steps they should take and your rights.

    If you visit the BERR website they give you all the information you need to know to read up on before your meeting.

    That includes the reasons for your selection, your rights, payments, etc.

    If your position is confirmed as redundant then you have the right of appeal.

    Until you have gone through this unfortunate process then you cant take any legal action.
