    Default Several redundancy questions

    Hi,

    In April 2011 the company that I have worked for since May 2010 decided to merge with another company. I was made aware of this merger about a month prior to the merger and it was understood that my role may be at risk of redundancy - these conversations were purely informal though.
    The merger went through and we relocated and it was not until 1st June that I was given a letter inviting me to a meeting to discuss the fact that my role was at risk and the meeting took place the following Friday (3rd) where I was given a breakdown of what I was monetarily being offered and my proposed leaving date (1st July). As my service was only just over a year at this point the monetary offer was adequate, although nothing to get excited about, and my Director did inform me that they would not deduct over taken holidays from me as I technically owed them 5 days. All in all, although not happy with the situation, it seemed acceptable.

    Before all of this was formalised I had been to a few job agencies to start looking for alternative employment and was informed at one interview that the company that we had merged with had been advertising for a junior accounts role ( I currently work in a more senior accounts role). As this role was available and it was known, although not yet formalised, that my current role would be ending, should I have been offered that role before they gave it to someone else? I appreciate that as it was a more junior role that I am currently doing, they may have thought that I would not have been interested, but surely that should have been my choice?

    My leaving terms are 4 weeks notice of which I am halfway through and and still working it and as previously stated my over-taken holidays were not clawed back.

    Any advice would be appreciated

    Your entitlement was to be considered for an equivalent post - a more junior post may not have entered their minds. It was as much your responsibility to ask about posts that may not have been equivalent but which you may have been prepared to consider. Given that the employer has been more generous than they have needed to be, this would indicate that there was little overwhelming desire to get rid of you. Have you asked then? The post may not have bee filled or there may be others if they know you would consider below your current grade.
