Hi,
A few years ago I was TUPE transferred from a UK government agency into a small business association. Before transfer I was at risk of redundancy and would have received severance payment in line with the standard Civil Service Severance Scheme if made redundant. I was a member of the Civil Service Pension Scheme. I transferred via TUPE on exisiting terms and conditions. My new employer provided a new acceptable pension scheme and does recognise continuity of service.
However....I am now at risk of redundancy in my current post and the proposal for redundancy payment is based on statutory guidelines. Is this acceptable under TUPE?

If your terms and conditions of employment were changed - then yes, I am afraid it is. TUPE protections do not last for ever (or for very long at all in fact) but they have to be changed like any other contractual terms.

If your contract has not changed them the conditions you transferred with remain in place.
