I've recently been given my notice at my company, and feel like I have been unfairly selected. I would appreciate any advice you can give me.
I work at a Software Developement company, and have been working with them for 3 years in one form or another. My first two years, I worked freelance, but pretty much worked with them in their offices full time, and then after 2 years they made me a full PAYE employee.
Until recently, we had two projects in development. I was the Project Manager on what I will call Project A. There was also a Project B, which was terminated by the customer on Wednesday of last week. This lead to the termination of contractors on the project, and some PAYE staff being given their notice.
I was also given my notice, and I feel I have been unfairly selected. Here are my reasons:
1) My role on the project still seems to be there, but has been given to someone who is a lower cost to the company.
2) I am the only person on my project being made redundant, all other contractors and PAYE staff are still working on it
3) My role is charged out to the customer in the pricing for the project which is still continuing.
4)I've been told informally and verbaly this is for cost reasons by one of the managment.
Although I do understand my companies need to save money, I feel like this is unfair reason to make me redundant. Would I be correct in this?
On top of this, I have been give no consultancy, where I would have been willing to discuss working compressed hours, a short term paycut, or other roles or responsibilites I could have done within the company.
What I am thinking of doing is writting an email to my employer raising these issues, and say I would like to find a fair and amicable solution to this for all parties.
My thinking is that they should pay me my notice + holidays and allow me to go home now, and pay me a sum of £1500. The reason I have chosen this figure is that it is the value in Statutory redundancy that I would have received if I had been a PAYE employee for three years. (I have assumed I am entitled to £0 statutory redundancy as I have only been a PAYE employee for 1 year). Should they do this I would be willing so sign a compromise agreement?
£1500 represents less that 1 months wages to my company, so would still allow them to achieve their goal of saving money, but would help mitigate my risk of supporting my family while I search for new employment.
Would this seem like a wise approach? Do I have a leg to stand on?
Am I being nieve in this way of thinking, or perhaps I am entitled to more?
