    Default Redundancy - Assesments for roles

    Hi

    Can anyone help please. My employer is facing massive restructure and is losing 2/3 of its 2000 strong workforce nationally. As a result I am under threat of redundancy and TUPE at the same time.
    As there are less roles everyone of my grade and below must be assessed and ranked. the lucky 1/3 will get a job role.
    My issue is that I am a manager (one of 13 to be assessed for 5 jobs under the new structure). but my actual specialised job has been ring fenced for my line manager who is the same grade, in addition a further 2.6 people of the same grade also have ring fenced jobs - these 3.6 people are exempt from assessments. My query is that me and my colleagues should be able to apply for these jobs of the same grade which are management jobs . In my case I manage a whole county but have been told I can not apply as it is a regional role but in practise I do manage a region
    Do I have a case for tribunal should I be unsuccessful at assessment as I have been prevented for applying for the job most suited to my skill set - thanks

    I couldn't possibly say. I have no knowldege or sight of the details, no understanding of why the employer has chosen this method of ring-fencing, or anything else. Nobody could tell you without this information, so I think you would have to seek legal advice if you have no union to go to.

    the jobs have been ring fenced as the people in those roles are favoured by operations managers and they want to retain them n therfore have made them exempt from TUPE & redundancy. We were not advised of this but shown on a powerpoint slide. We were given the info as part of a collective consultation and I guess that my employer did not believe that it would be questioned. Only the people in the ring fenced jobs were told that they wouldnt have to be assessed

    That still doesn't give me any of the information I need to say - you really do have to get legal advice on this. Sorry, but this is too detailed to handle here.
