    Default Redundancy & annual holidays

    Hi there,
    On Friday I was told I was being made redundant.
    I was told to e-mail my boss with details of remaining holidays and when I would like to finish working.
    As I work in events we get holidays in lieu. This means I haven't used any of my annual leave as my holidays have been taken from the extra hours gained from time in lieu.
    My contract says I must be given 4 weeks notice.
    I have 75% of my annual leave= 4 weeks and 3 days holiday.
    What is confusing me is that I am owed 4 weeks pay from the redundancy and 4 weeks annual leave.
    Do I need to work the 4 weeks to get the redundancy pay?
    If I was to take the 4 weeks redundancy time as holidays would I only get 4 weeks pay, or am I due 8 weeks and 3 days pay from annual leave and redundancy?

    Hope this makes sense and any help would be fantastic.
    Please ask any questions that would help find an answer.

    Yes it makes sense. The answer is that it is up to your employer. They can insist that you take annual leave during your notice period. Only if they refuse this must they pay you for it.

    One question. And a piece of advice. You have an awful lot of holiday left. Most people's leave year runs from January to December or April to March. There is not right to carry over unused leave. Are you sure you have that much holiday left?? And it is better practice to use up holiday rather than your extra hours (and actually, even better practice to use up both - there is a reason for holidays and compensatory - in lieu - time, and it is not for the health benefits to the legislators. It is to ensure that you do not overwork and damage your health!). Authorised additional hours worked have no expiry date in law, so the only expiry date is the employers policy on using the hours. Annual leave has an expiry date - the end of the leave year.

    Thanks for this advise.
    She mentioned with holidays it might be the case I only work one week etc.
    I just don't want to be done out of any money.

    My holiday year is August through to July. Our down time is end of May start of June.
    The time was going to be taken off then
    Thank you for your concern but I have had plenty 4 day holidays throughout the year. I have had more than the state annual 28 days, but they have all been from time in lieu.

    I haven't had to use any state holiday so worked from august till now, 83.3% of my working year.
