Default Can I still claim statutory redundancy if I am working my notice?






Hi,

It is likely I will be made redundant shortly as my company is on the road to insolvency (currently in administration). If I hand my notice in and we go under, am I still entitled to redundancy pay, owed holiday time, etc? If not, what could I claim, anything?
Thanks in advance for your advice. Much appreciated in these testing times.

If you have not yet been made redundant you will not be entitled to redundancy pay, which you can only claim if you have 2 years continuous service. If you hand you notice in before being wound up you will not be entitled to redundancy but you will be entitled to holiday pay and salary which will be guaranteed by the government. arrears of pay — includes commission, overtime and guarantee payments. Expenses are not included in pay. The employee can only claim net pay, after deductions for tax and national insurance, and can only claim up to a maximum of eight weeks' pay. The employee may not receive all the pay they are owed as there is a maximum weekly limit that can be paid irrespective of how much the employee earns.
