Hi.
I have recently been TUPE'd to a new company after my previous employer lost a big contract.
My new employer, today, has told me that myself and 14 others transferd under the TUPE regulation are now to enter a redundancy consultation period.
My new employer employs over 1000 people doing a similar role to myself. The other employee's are multi client trained and at present I am only working with with 1 client.
My new employer has confirmed that 4 positions will be available after this consultation period but only 1 in my geographical location
Is it right that my new employer can only put the people who were TUPE'd up for redundancy?
Does the TUPE regulation protect my employment in any way?
Any advice anyone could give would be very helpful.

Oh dear - this is a bad day for advice because so many questions seem to be about how limited the law is. The employer is not putting "only people who were TUPE'd" up for selection - because it would be quite wrong to only select from people who had been TUPE'd. That would potentially be selection connected with the TUPE. But that isn't what they are doing. They are putting up for selection those people who are not multi-client trained because their business requires people who are multi-client trained. That is a fair (in law - I am not talking about the world here) thing for them to decide. You need to demonstrate that amongst the people not in the pool are others who have no multi-client skills.

Thanks for asking this question and so well too, it answers the exact thing I was wondering seems we are at the end of a short sharp stick.and the remark in the letter regards skill set and knowledge is just insulting.

Yes, I am afraid that TUPE provides significantly less protection than most people think it does, and it would appear that in the real world scenario, those protections are getting less and less every day. It is not hard for an employer to find ways around the protections.
