    Default how long before starting new jib

    hi there, I am new to this forum, my son was made redundant last tuesday, he has been employed at the firm for just over 5 years, the firm was made insolvant, today he was contacted and offered a job by a company who has taken over, they want him to start tomorrow, will he still receive his redundancy , kindest regards , Irene

    Possibly not - and to be honest, although it may not feel that way right now, he might be better off if not. This may be a TUPE transfer if the new company has bought out the other one - and that would mean he isn't redundant at all, but retains all his employment intact. That means he doesn't have to build up a years service to have rights against unfair dismissal etc., because he already has it. It may mean that he doesn't have a few weeks money in his pocket - he has legal rights instead. Given the world as it is right now, those rights are worth more. If he has been TUPE'd, it means that his employment continues as if there has been no break at all. If he is made redundant later, those 5 years are still there too. And hehas more rights than if he had just started a new job. He should ask the new employer if this is a TUPE transfer, preferably getting a response in writing if he can. Whatever they say, because in all likelihood, it is a TUPE, and he might want to protect his position, whatever they claim at some later stage. If all goes well he doesn't need evidence - but all doesn't go well all the time. Best to be prepared.
