What will my redundancy be calculated from?

    Default What will my redundancy be calculated from?

    Hi,

    I am currently on a 6 month secondment with a higher rate of pay compared to my old role.

    We have recently gone through a restructure and my old role is currently at risk or redundancy...

    My secondment ends in April whifch is at the end of the consultancy period AKA d-day...

    Now because I am on the higher rate of pay, is the redundancy calculated on your last 3 months pay or is this a company decision and now law?

    If i've been too vague then please let me know but answers as quick as possible would be brilliant.

    If it is a secondment, then the salary used is your substantive salary, not the higher one - because the latter is simply attached to the secondment and not your job.

    hmm bad news then - maybe i should keep quiet and see if they make an error with the redundancy calculations - the last time they did it was based on the past 3 months pay so i'm keeping my fingers crossed that happens again ...

    but that clears things up legal side...

    That assume that it is a formal secondment in legal terms - they may not have made the mistake, it might have been you! Things can get called secondments when they actually aren't. It's a buit like describing yellow - what colour exactly would that be?
