    Default Alternative Employment offered after Redundancy

    Hi

    I'm new here and could do with some help.... I was made redundant and my last day was 26th, I was told before i left that there I would be offered a sales job. this was verbal and I have nothing in writing and my redundancy is complete. As i worked for the company for just over a year i got one week notice and no redundancy pay.

    Can he offer me this new job? Isn't it in breach of the alternative employment arrangement and shouldn't he have sorted all details before my redundancy was up?

    I am expected to go into work on Mon 5th to sort the details of the new job - i don't really want it but cannot afford to be without work as i live on my own....

    Can i appeal and insist he didn't follow proceedures and demand the alternative role along with the paid 4 week trial????

    Happy New Year Julie although I am sorry about your situation with work.

    Sometimes it is possible to avoid redundancy dismissals by offering suitable alternative work . The suitable alternative work must be offered to before the expiry of their current contract. You would also be entitled to a trial period (paid) of four weeks.

    In any dismissal there is a right to appeal. In your case, I suggest you appeal with the grounds being that you were not offered the alternative employment which you believe was available before your termination.

    If a suitable alternative position is available and the employer does not offer it to an employee, the redundancy dismissal would be unfair dismissal. As you have over one year's service, you would qualify to apply to the Employments Tribunal for unfair dismissal.
