    Default Backdating Redundancy Notice / Posts not appointed

    Sorry for posting two questions in one but I thoughts they might interlink.

    As a company all staff received a letter notifying them of redundancies due to an organisational restructure. A 30 consultation period was completed due to more than 20 staff being made redundant. A recruitment process was completed for the new structure and I applied for two roles within it. I wasn't successful in either role however whilst 1 was appointed the other remains unfilled. I have had no feedback to why i was unsuitable for that role. I have since been invited to an individual consultation meeting in the new year.

    Question 1. - Regarding the unfilled role. Does this have any implications for myself as I believe I was reasonably competent for the role. Can they make me redundant whilst this remains unfilled?

    Question 2 - I am due a 3 month notice period (stated by the company in my redundancy FAQ document issued by them) but they want to back date that to the date of my last interview (12th Dec). Can they do that? Or should it be from the date the redundancy letter is issued post my individual consultation?

    Thank you for your question motherhen.

    In answer to your question, you shouldn't be confirmed redundant or given notice of dismissal on grounds of redundancy until after the consultation process is completed.

    I am not clear from your post whether you are still in consultation or whether this period has ended. Have you received notification that the consultation period has ended and you are to be made redundant?

    I would advise that you request feedback from your application for the alternative role to clarify why you have not been offered this role which remains unfilled.

    Thanks for your response.

    I have had a letter stating the company planned to make up to 25 redudancies as part of a restructure and had the restucture explained to me. The number of redudancies has also been registered with the DTI. I have had an email stating that the collective consultation period has ended. The email I recieved yesterday stated that i was personally "at risk" due to be unsucessful in my applications and was invited to an individual consultation meeting.

    I have asked for clarification on when i will recieve feedback on the roles I applied for as I have not recieved any yet. I have also asked for an agenda to outline the purpose on this individual meeting.
