    Default Valid reasons for ending trial period

    What reasons could be considered valid for me ending my trial period in an alternative role ? I'm concerned that I may find the new role is unable to fill my financial commitments (It pays around £8k less). Also, as I'm returning to blue collar work from a supervisory position, I might find it uncomfortable working with, and for, people I used to supervise. Would either of these reasons be considered valid to end the trial period and for me to take my original redundancy offer instead ?

    Thank you for your question although I am sorry to hear about your situation.

    I'm afraid there is no right or wrong answer to this question although there are reasons which do amount to what is not considered to be non-suitable alternative employment.

    In employment law, there are examples of what may not be considered to be non-suitable alternative alternative employment.

    One key reason is where a new role where no longer carries any supervisory and man-management responsibilities or a substantial change in role from white collar to blue collar work even if it is on the same pay.

    The question of whether alternative employment is suitable or not is subjective on your view. Therefore it is up to you to provide the argument to your employer that you deem the alternative employment unsuitable with justified reasons. However, on the face of it, it seems reasonable that you deem the alternative employment unsuitable.

    A refusal of suitable alternative employment can lead to a loss of the right to a redundancy payment. However, this will only happen where your employer does not accept your refusal. You would then have to apply to the Employment Tribunals.

    I appreciate your response. And it would seem that there is no definitive answer. Fortunately (or unfortunately) the point has become moot, as the offer of alternative employment has been withdrawn and I finish at my present company on the 2nd January.
    However, I start work for another company on the 5th January. :-)
