    Default Question about redundancy

    I was made redundant on 27th November.

    This site's domain ends in .co.uk, so I assume it is a UK site focusing on UK employment law, but to clarify, I am a UK resident working within the UK.

    I am still awaiting my reference and redundancy letter, along with redundancy pay of 1 week (this is what I was told I will be getting).

    Is it normal for it to take this long to arrive? I was told I will recieve the letters in a few days, from an email last week from a manager at the company in question. He is out of the office though, so I don't know what the status is on that. Interestingly, despite the ID I gave my employer, my contact details were incorrect.

    Is there a scenario where I may not be entitled to redundancy pay? I was on probabation from September (when I began) - December, and was told I will be made redundant on that day (27th Nov). No notice.

    My contract only really says I am entitled to my benefits/salary during my garden leave period (I was made redundant and was at home from the next day onwards). I am still bound to the contract, though, during my garden leave period. I assume the garden leave period is only from when I am redundant to payday. Pay is on 25th of every month, although given the month we are in now, and the time of the year, pay was proposed to be before (don't know when though).

    It's not a case of simply not being kept on. I performed well so if the economy was different I would be there. As my boss said, it is more due to the company than the employee (me).

    Is everything in order? By law, what am I owed?

    I am sorry to hear about your situation. I was a bit confused by your message and I can only give advice on the facts you have posted. However, all companies must follow the statutory dismissal procedure for redundancies and consult with at risk employees. It seems from your message that this has not happened and that you have just been told you are going.

    You need to refer to your contract of employment with regards to notice but I have assumed that it is a week. This notice only takes effect after your consultation period. Due to your short service you are not entitled to Statutory Redundancy Pay, only notice pay.

    You dont say what position you hold and therefore I would question why you are on garden leave unless you are construing this because they have said you can remain at home during consultation.

    Also, you need to review if you held the only position in the company or not so that you can question why your position was made redundant. Were there any others made redundant at the same time? If not, then you need to ask this.

    I think that you need to contact someone higher than your manager if he is not available or even the HR Department, if they have one with regards to the procedure they are following and query why you've not had anything in writing yet to confirm this process and the situation.

    Once you have the details confirmed to you, either post another message or visit the Acas or BERR websites where you can find extensive information regarding redundancies.
