Default 3 Years Temp, 7 years contract - Redundancy?

    Hi there,

I'm new to all of this, so was hoping someone on here could give me some clarification.

I was a temp for 3 years, and then they made me permanent. I have been permanent for 7 years now, but we have been informed that we will be made redundant.

I was wondering if I had any (legal?) right in getting redundancy pay for the 3 years as a temp?

I know an ex-colleague did when they were made redundant last year, but that was before we merged/intergrated with a sister company.

Any info would be a great help

    Thanks very much

    AK

The merger isn't relavnt. Provided that there was no break in service between the temporary work and the permanant contract, then all are counted

    Hi SarEl,

Thanks very much for the reply. No problem with the spelling! I'm very grateful for the response and very happy to find out I'm entitled to 3 more years redundancy!

    Thanks again

    Hi again,

Sorry to be a pain but I have another question in regards to redundancy.

I am wondering if I am entitled to 2 months redundancy pay when I first joined the company. There wasnt a contract or anything, just a verbal agreement, so I guess I was classed as a casual. Is that correct?

Just to make things clearer. I started Nov 2000, worked full time mon-fri 9-5pm, and was then given a tempoary contract 2 Jan 2001.

Do I have any hope of redundo payment even though there is no documentation of my employment for those two months?

    Thanks

All continuous service counts. But if the company deny it existed, can you evidence it?

Ah ok thanks. I dont seem to have any documentation to support my case. I can only remember myself (as do others) because I went to the christmas party that year.

Would it be worth me requesting a bank statement from november and december to show that I was paid (hopefully by bacs or cheque!) by the company?

Possibly - provided that the two months are worth it because bank statements will cost!
