Hi All
hope you can help me, i'm currently on maternity leave and am due to go back to work on december the 19th after 39 weeks of maternity (i did give 8 weeks notice to my employer that i would be returning early), however i found out on 3rd of november (my colleagues found out on oct 31st) that the business will be closing and we're all getting made redundant. i've been told that my redundancy pay is worked out off my maternity pay and not my regular earnings before i started maternity leave, i'm almost certain that this is not right but would like it confirming please!!
many thanks
Jo

redundancy whilst on maternity leave

Hi Jo
Thank you for your question although I am sorry to hear that the company you work for is closing.
When a company calculates redundancy pay, continuous length of service must include any periods of maternity leave. How long have you been continuously employed for?
Whether you are are on ordinary maternity leave or additional maternity leave, your redundancy pay should be calculated using the hours that you are contracted to work. E.g. if your normal contract of work is 40 hours full time, your redundancy pay will be based on your earnings for a full time week.
I hope this has helped you. Please let me know if you have any further developments that you need help with.Clara Buckingham
