redundancy criteria point system the company that I work for has just announced the point system for redundancy criteria.The attendance pts start at 10 and you lose 1 pt for every day off and 1 pt for every occasion.Qualifications are worth max 5 pts,length of service 1/2 pt per year,skills max 5 pts,future potential max 5 pts,flexibility max 5 pts.As I have had two illnesses this year and have had 20 days off I have no chance of being kept on as this puts me on -12 to begin with and there is no way to catch up.Is this a fair system and is it legal ? as it just seems to be loaded to get rid of people who have lost time this year.Last edited by celtic67uk; 19-11-08 at 12:24 AM.

Hi, thank you for your question.
It is legal for a company to use sickness and absence as a criteria for redundancy however care must be taken to avoid discrimination under the Disability Discrimination Act.
Can you check and clarify how the absence is calculated for the redundancy criteria please?
I suspect that your company may calculate the points for sickness and absence in a certain way (see below) as it doesn't make sense that there no maximum points threshold. Somebody who has been absent for a year would have 365 points.
No. of occasions x No. of days absent (to a maximum of 5).
So your absence would be;
2 occasions x 20 days = 10 points.
Can you clarify this information and reply to me? Please ask your employer for full details of the selection criteria.

my manager has told me that the way of obtaining points for absence is that the amount of days is added to the occasion and taken away from 10,therefore my total will be 10 -20 -2 = -12, therefore if someone was off for a year they would have a score of -355.The other scores available are so low it is imppossible to attain a good score if your attendance is bad.Last edited by celtic67uk; 19-11-08 at 05:42 PM.
