I have been given the option of going self employed or having my contract terminated as my position is no longer tenable.
I initially worked for my employer as a consultant for three months before becoming an employee on the first of November 2009. I report into the MD and in March I recruited an assistant to manage some of my workload (sales) whilst I focussed on mentoring a number of field based consultants (all self employed).
The assistant found the sales tough and four weeks ago the MD decided I should take over the sales while the person I recruited focussed on the mentoring. I was set sales targets from sept this year.
I have today been told that unless I go back to working as a self employed consultant my contract will be terminated.
I have a three month notice period in my contract. The person I recruited has not received any notification of redundancy.
Does my consultancy work count towards my service?
If they terminate my contract and I work the three months notice I would then have completed one year service (or 1 year 3 months if my consultancy counts). Could I then claim unfair dismissal?
As I am now doing the role of the person I recruited, should they have been consulted as part of the redundancy process?
Any help or advise would be great.
I have a meeting with the MD tomorrow pm.
