Reorganisation Redundancy?

    Angry Reorganisation Redundancy?

    Hi

    I have just been told that I am to be made redundant. I have been looking through the online advice and see that reorganisation of a workplace is a valid reason for redundancy if the work is no longer required or is to be done by other people. I work in a team with three people at the same level as me, and what they have done with the reorganisation is to take the tasks that the three of us do and mix them up so that none of the new roles are the same as the old roles, but all the same tasks stilll have to be done. I want to know if this counts as a valid reason for redundancy?

    Also, I had been ill earlier in the year and was off for three months. It was while I was off that I had to complete the forms that were used in the selection process. I'm not sure yet if these forms were the only evidence used in the selection, but can't help feeling that its unfair to expect someone who's unfit for work to be able to complete such a form to the best of their ability. Would you say this was fair? I have an impeccable performance and disciplinary records - can they use the fact that I have been off sick as a factor in their decision?

    It's a valid reason for redundancy if as part of the reorganisation they now need less people doing those tasks, yes.

    It's normal for sickness absence record to be used as part of selection criteria when selecting people for redundancy, usually alongside performance, skills, experience, disciplinary record etc, however you should have been told what the selection criteria were before the decision was made final.

    I do actually think it's reasonable for employer to believe that just because someone is unfit to come to the office and work that doesn't automatically mean they are also unfit to fill in a form. However it would obviously also depend on what the illness was, what symptoms you were suffering.

    If you felt your condition meant you were not able to complete the form, you should have raised your concerns with your employers in terms of what you were finding difficult and what support you needed to complete the form. Did you do that?
