    Angry Repeated request to extend notice period

    Hi
    In Feb 2008, My company announced it was closing in Dec 2009 & transferring all functions to other countries. Due to complexity this hasn't happened yet. I was placed under formal notice of redundancy in December 2009 with 3 month's notice. As I haven't got another job this has been extended twice with my consent but I'd now like to leave with my full enhanced package. My company has now said everyone still employed will have to remain onsite as there are unforseen issues and closure is further delayed. As they placed me under notice, can this be forced upon me? My statutory notice is 3 months.

    There was over 300 employees and as people have retired, been made redundant etc., only about 50 remain.

    (I've over 10 years service and the consultation group hasn't been granted a meeting with management for months. )

    Any suggestions what my options are?

    If they gave you 3 months' notice in December presumably your end date was supposed to be in March? You say it's been extended twice since then, are they doing it on a month-by-month basis or something? What's your end date now?

    I'd suggest you work on the assumption that the latest end date you have been given is final. If they ask you to extend it again (you say it's been extended with your consent before, so presumably they are happy to ask for consent rather than impose?), just refuse. If they try to insist, you can give them written counter-notice, which would be saying that you would like to leave on the end date they gave you and take redundancy at that point. Have a read Finding employment after redundancy : Directgov - Employment Your employer can technically refuse to accept counter notice, and if you then leave and they refuse to pay you your redundancy, you could take it to a tribunal. A tribunal would look at how reasonable it was for your employer to refuse your counter notice, and given the fact that you have already had your notice extended, it's likely it would not be reasonable of them to refuse.
