Redundancy and Upcoming Pay Review/Bonus in Contract
Hi,
Hope someone can answer my query
Basically In my contract I have to complete certain goals to get my bonus (not company performance related) by the end of this Month, the bonus is Paid at the End of July and this bonus amount will be added to my basic pay as a pay rise as from May. Yesterday my job was "put at risk" with no prospect of future jobs so redundancy is whats going to happen. They are basing my redundancy on my current contract amount, but in 4 days it was meant to go up. where do i stand? my job is being outsourced and as i have completed all my goals for the bonus/rise i believe the 3 month notice period i have should be paid with the bonus at the higher rate as this is what it would be if i was still employed with them.
Also they gave me 3 days to prepare for the meeting which they officially tell me i'm redundant which is convienently 2 days before the end of the month. If the meeting is moved till the first day in May does this change things?
ANy advice appreciated.

Redundancy pay should be worked out on the basis of your pay at the date your employment ends, so it depends whether your last day of employment is before or after your pay rise.

Hi,
So it sounds like their trying to get the meeting in this week (29th) before my contract changes on the 1st so they can pay me less, i've only been told my jobs at risk at the moment, but from what they said its been outsourced so i'm definately being made redundant which is the meeting on the 29th.
Am i within my right to ask for it to be moved to after the 1st May?

You can certainly ask, yes. You haven't been given much notice at all, so you could ask for it to be postponed on those grounds. Are you bringing a colleague with you? You could say you want to bring someone but haven't been given enough notice to enable you to find someone, could they give you a few more days.
It's all about when employment actually ends though, not when you are officially given notice, so unless you think your employment will end on the spot, it may not be a problem.

So if they officially say i'm being made redundant and I dont have to work my notice period (3 months) then would this Thursday count as being the last day?
If so then i'll need to move it, they have already given me a sample redundancy payout letter based on my current pay which is due to go up from the 1st May so wouldnt be correct then.
My worry is they are trying to push it forward to make sure they only pay the lowest redundancy/pay and what i would have earnt in the next 3 months would be more than they are willing to pay now.

They will need to tell you in writing what your last day of employment actually is. So that could be Thursday in theory yes. If they don't require you to work your notice period they may want to put you on garden leave instead, meaning your employment will end after 3 months.
Is there anything in your contract about payment in lieu of notice?
