    Default Ending Trial Period to leave for a new job

    Hello,

    I have decided, during the statutory trial period, that my new job isn't suitable due to personal reasons that involve me relocting to a different part of the country. I have given notice during the trial period but also have accepted on offer for a new job. My question is does this affect my right to a statutory redundancy payment?

    Any help would be much appreciated!

    Accepting a job at a different employer doesn't affect your entitlement to redundancy from your existing employer if the alternative you've been offered and have been trialling with your existing employer isn't suitable.

    It's not clear whether you think it's unsuitable because it would require you to relocate, or because you want to relocate and therefore won't be able to do the job. If it's the latter, then the job isn't unsuitable in terms of the legal definition; not taking it would be your decision so you would forfeit your redundancy.

    If taking the job you are trialling would mean relocating and you don't want to do so, then you are within your rights to say it is not a suitable alternative and can retain your redundancy.

    Hi,

    Thanks for the reply.

    I feel the alternative is unsuitable due to personal reasons as it requires relocating to a different area of the country and that is something I do not want to do.

    That's true relocating to a different part of the country would be a hectic job. There are many who wouldn't love the idea to relocate including me, but there would be some who would this kind of job. Relocation would not be a problem to them, coming back to your query it is better that you did mention to them right in the trial period itself about your inconvenience for the job. This saved you a lot of effort and kept you on the right track.
