My husband was transferred to another company under the TUPE in May last year. He has still not been taken on by the new company with a contract and is still under his old terms and conditions.
There has been an announcement that redundancies are going to be made by this company over the coming year.
How does he stand on being made redundant, if he is picked. His old company is about to go backrupt.
Thanks.

Transferred under TUPE, worried about redundancy

He doesn't necessarily need a new contract. His new employer are obliged to keep his continuous service and existing terms and conditions intact, so as long as he was notified in writing of the transfer of his employment, that's fine, there's no need for a whole new contract.
In terms of redundancies, he's in exactly the same position as anyone else working for the new company. The only difference might be if he has a redundancy package specified as part of his terms and conditions, his new employer would be obliged to honour that. But he's no more or less vulnerable than anyone else.
